Garanzia legale di conformità
Two years of cover from delivery under Italian law, given to you by statute and not by us. This page explains what it covers, what it does not, and the four remedies you can ask for.

Governing law
Italian law. The exclusive forum is the court of the consumer’s place of residence or domicile.
What you have
Every garment sold here carries the garanzia legale di conformità for 2 years from delivery, under articles 128 to 135-septies of the Italian Consumer Code, implementing directive (EU) 2019/771.
This is a legal right. It costs nothing, cannot be waived, does not depend on registering anything, and is not affected by whether you kept the receipt — the order record on our side is proof enough. It runs alongside the 14-day right of withdrawal rather than replacing it.
The reversed burden of proof
For the first year after delivery, any lack of conformity that appears is presumed to have existed at delivery. You do not have to prove anything; if we want to refuse a claim, we have to prove that the garment was conforming when it left us.
After the first year and up to two years, the presumption reverses and the burden shifts to you. In practice we do not send people away over this — a seam that opens at eighteen months is a seam that was badly sewn.
You must report a lack of conformity within two months of discovering it. Report it as soon as you notice.
What counts as a lack of conformity
The garment does not conform if it departs from what was agreed. Concretely:
- It does not match the description on the product page. The page states the interlining, the composition, the cloth weight, the lining, the fill figures and both origins. If the sewn-in label or the garment itself disagrees with any of them, that is a conformity defect and one of the clearest kinds.
- Construction failure. Seams opening, a lining tearing away at the armhole, a zip separating under normal use, buttons whose shanks pull through the cloth, a collar that will not sit.
- Interlining failure. A fused front that delaminates and bubbles is a defect, not wear, when it happens within the guarantee period and the garment has been cared for as the page instructs.
- Fill failure. Down migrating out through the shell, or baffle walls giving way so the fill collects at the hem.
- Finish failure. Where we published a water-repellency rating, the fabric failing to meet it as supplied.
- Not fit for the ordinary purpose of a garment of that kind, or lacking a quality that is normal for such goods and that you could reasonably expect.
What does not count
Being clear about this now saves you posting a coat back for nothing.
- Normal wear. Cuffs and collar edges softening, a lining thinning at the seat, soles of pockets wearing. A lining is a consumable part of a coat and is designed to be replaceable.
- Pilling from abrasion, particularly on cashmere and cashmere blends, under a bag strap or a seat belt. It is a property of the fibre, disclosed on the page.
- Linen creasing. Stated on the product page before purchase.
- Suede marking and darkening from water and handling. Stated on the product page before purchase.
- Loss of a repellent finish after cleaning, where the page told you that cleaning removes it and how to restore it.
- Damage from care contrary to the instructions, from accident, from alteration by a third party, or from a repair carried out elsewhere.
- Fit. A garment that does not suit you is not a defective garment. That is what the 14-day withdrawal right is for, and why every size is measured flat on the page.
Your remedies, in the order the law puts them
- Repair or replacement, free of charge, within a reasonable time and without significant inconvenience to you. The choice between the two is yours, unless the one you chose is impossible or would cost us disproportionately more — in which case we have to say so and explain why.
- A proportionate price reduction, if repair or replacement is impossible, if we do not carry it out within a reasonable time, or if the defect reappears.
- Termination of the contract with a full refund, on the same conditions. You cannot terminate for a defect that is only minor — but the burden of showing it is minor is ours, not yours.
We bear every cost of putting a conformity defect right: return carriage, postage, labour and materials. You are never asked to contribute.
How to claim
- Email support@leclothing.shop with your order number, what has happened and when you noticed. Photographs help enormously — a close shot of the affected area and one of the whole garment.
- We reply within one business day. If we need the garment we send a prepaid label; you never pay to send back something we may have got wrong.
- We assess within five business days of arrival and tell you what we found and what we propose.
- If a refund is the outcome, the refund policy governs how it is paid.
No commercial warranty on top
We offer no additional commercial warranty, no extended cover and no paid protection plan. The statutory guarantee is what you have, and selling you a worse version of a right you already hold for free would be a poor thing to do. We also make no durability claim of our own — no promise that a coat will last a set number of years — because such a promise would be a commercial guarantee we could not evidence.
If we disagree
Ask for the assessment to be reviewed and a different person will look at it. Beyond that, three independent routes are open to you and are listed on the policies page. Your statutory rights are unaffected by anything we decide.
